Shipping & Returns
At Ngeo Namibia, we strive to ensure that our customers are satisfied with their vehicle purchases. However, we understand that circumstances may arise where a return is necessary. This Vehicle Return Policy ("Policy") outlines the terms and conditions under which a vehicle may be returned to Ngeo Namibia ("we," "us," "our"). By purchasing a vehicle from us, you agree to the terms of this Policy.

General Conditions

1.1. Applicability

1.2. Consumer Protection
This Policy is drafted in compliance with the Consumer Protection Act, 68 of 2008 ("CPA"), and other relevant South African legislation. Where this Policy conflicts with any statutory rights, the provisions of the CPA will prevail.

2.1. Return Period
New vehicles may be returned within 7 calendar days from the date of delivery or handover, provided that the vehicle has not been driven more than 100 kilometers and is in the same condition as when sold. The vehicle must include all original documentation, accessories, and packaging.

Returns of new vehicles will only be accepted if the vehicle.

Return of Used Vehicles

3.1. Sale Finality
All sales of used vehicles are generally considered final. Returns of used vehicles will only be accepted under specific conditions as outlined below.

3.2. Misrepresentation or Latent Defects
If the used vehicle was sold with a material misrepresentation regarding its condition or history, or if a latent defect (a defect that was not visible or detectable at the time of sale) is discovered within 6 months of purchase, the customer may be entitled to a return, repair, or replacement, as per the CPA.

3.3. Inspection and Assessment
Upon notification of a defect or misrepresentation, Ngeo Namibia will conduct an inspection and assessment to determine the validity of the claim. If the claim is valid, the customer may choose between a return, repair, or replacement of the vehicle.

3.4. Refund or Replacement
If a return is accepted, the customer will receive a refund of the purchase price, minus any applicable deductions for wear and tear, mileage, or damage incurred after the sale. Alternatively, a replacement vehicle of similar value and condition may be offered.

4. Non-Returnable Vehicles
The following vehicles are not eligible for return:
Vehicles purchased "as-is" without a warranty, unless a latent defect is discovered within the statutory period;
Vehicles that have been modified, altered, or damaged after delivery;
Vehicles used for commercial purposes unless agreed upon in writing.

Return Procedure

5.1. Initiating a Return
To initiate a return, the customer must contact Ngeo Namibia within the applicable return period, providing details of the vehicle and the reason for the return. All returns must be authorized in writing by Ngeo Namibia.

5.2. Inspection
Upon authorization, the vehicle must be returned to Ngeo Namibia for inspection. The inspection will assess the vehicle’s condition and verify the claim's validity.

5.3. Documentation
Customers must provide all original purchase documents, including the sales agreement, proof of payment, and any other relevant documentation. Failure to provide the required documents may result in the return being denied.

Fees and Charges

6.1. Inspection Fees
In cases where the return is not due to a defect or misrepresentation, an inspection fee may be charged. This fee will be communicated to the customer before the inspection.

6.2. Restocking Fees
For new vehicles, a restocking fee of up to 10% of the purchase price may be deducted from the refund amount.

6.3. Transportation Costs
The customer is responsible for all transportation costs associated with returning the vehicle unless the return is due to a defect or misrepresentation.

Dispute Resolution

7.1. Mediation
In the event of a dispute regarding a return, we encourage customers to engage in mediation to resolve the issue amicably. Mediation will be conducted in accordance with the provisions of the CPA.

7.2. Legal Recourse
If mediation fails, customers may pursue legal recourse under South African law. Any legal action must be filed within the jurisdiction of the courts of South Africa.

Ngeo Namibia reserves the right to amend this Policy at any time. Any changes will be posted on our website and will take effect immediately upon posting. It is the customer's responsibility to review this Policy periodically.
